CAMP FIRE MINNESOTA – PARTICIPANT WAIVER AND RELEASE OF LIABILITY
I do hereby affirm and acknowledge that I have been fully informed of the inherent hazards and risks associated with outdoor recreational activities at Camp Fire Minnesota, including but not limited to ice fishing, snowmobiling, canoeing, swimming, and other outdoor pursuits. I fully understand that these risks can lead to severe injury and even loss of life. I understand that outdoor activities may be conducted in areas that are remote from competent medical assistance; nevertheless, I choose to proceed even in the absence of immediate medical assistance.
Additionally, I understand that there are risks associated with outdoor recreation, including but not limited to potential injury, loss of life, or property damage due to natural conditions, weather, terrain, wildlife encounters, and the actions of other participants. Despite the potential hazards and dangers associated with these activities, I wish to proceed and freely accept and expressly assume all risks, dangers, and hazards that may arise, which could result in personal injury, loss of life, or property damage to me.
RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNITY AGREEMENT
In consideration of being allowed to participate in outdoor recreational activities, as well as the use of Camp Fire Minnesota’s facilities and equipment, I hereby agree as follows:
TO WAIVE AND RELEASE ANY AND ALL CLAIMS based upon negligence, active or passive, that I may have in the future against Camp Fire Minnesota, its directors, employees, representatives, agents, and volunteers (hereafter referred to as “Releasees”).
To release the Releasees from liability and responsibility whatsoever for any claims or causes of action that I, my estate, heirs, executors, or assigns may have for personal injury, property damage, or wrongful death arising from participation in Camp Fire Minnesota activities, whether caused by active or passive negligence of the Releasees or otherwise. By executing this document, I agree to hold the Releasees harmless for any claim arising out of my injury or loss of life that may occur during participation in Camp Fire Minnesota activities.
This Release does not apply to injuries caused by reckless or intentional misconduct by a Releasee.
By entering into this agreement, I am not relying on any oral or written representation or statements made by the Releasees, other than what is expressly set forth in this agreement.
If any provision of this release is found to be unenforceable or invalid, that provision shall be severed from this contract. The remainder of this contract will then be construed as though the unenforceable provision had never been contained in this document.
I hereby declare that I am of legal age and competent to sign this Agreement, or, if not, that my parent or legal guardian shall sign on my behalf, and that my parent or legal guardian is in complete understanding and concurrence with this Agreement.
I HAVE READ THIS AGREEMENT, I UNDERSTAND IT, AND I AGREE TO BE BOUND BY IT.
For Participants who are minor children:
I am the parent or legal guardian for the minor child listed. I have read this Waiver and Release, and I agree that the minor child may participate in the subject activities. I understand and agree that I am waiving all claims that I or the minor child may have against the Releasees for injuries or death related to the minor child’s participation in activities at Camp Fire Minnesota.
